Reduced Exam Retake Waiting Periods for Broker Dealers

FINRA has filed a proposed rule change to amend Rule 1210 (Registration Requirements) to shorten the mandatory waiting periods for individuals retaking failed qualification examinations. Under the proposal, the waiting period for the first and second failed attempts would be reduced from 30 days to 15 calendar days, while the wait for third and subsequent failures within a two-year period would drop from 180 days to 60 calendar days. Until FINRA announces a specific implementation date in a future Regulatory Notice, candidates must continue to adhere to the existing 30-day and 180-day waiting periods.

The proposed adjustments are intended to apply exclusively to FINRA-administered examinations, such as the SIE, Series 7, and Series 24. Exams administered on behalf of other organizations, including the MSRB, NFA, and NASAA (such as the Series 63, 65, and 66), are not currently impacted and would remain subject to the original, longer waiting periods. FINRA indicates that these changes respond to industry feedback regarding the burdens placed on individuals entering the securities workforce. The organization suggests that its use of extensive question banks and advanced data forensics allows for these shorter windows without necessarily compromising examination integrity.

Diles Consulting observes that this transition period, where a rule is "effective" but not yet "implemented," requires firms to maintain precise oversight of their registration and onboarding processes. Our company recognizes that managing disparate retake timelines between FINRA and non-FINRA exams may introduce operational complexities for broker-dealers. Led by Founding Principal Colleen Diles, who brings 22 years of experience at FINRA and over 30 years in the securities industry, Diles Consulting provides the strategic guidance necessary to evaluate the effectiveness of firm controls during such regulatory shifts. Our company assists clients in identifying business and operational risks, ensuring that internal registration tracking and compliance tasks remain robust and audit-ready as the industry awaits the final implementation date.
